1. Agreement to Terms

By engaging Creavibe Digital, a product of RoyalSoft LLC ("we", "us", or "our") for digital marketing services, you ("client", "you", or "your") agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Creavibe Digital.

2. Services Provided

Creavibe Digital provides professional digital marketing services including but not limited to:

• Content Marketing & SEO Strategy
• Social Media Management and Marketing
• Paid Advertising (Meta, Google, LinkedIn)
• Email Marketing Campaigns
• Marketing Analytics and Reporting
• Marketing Automation
• Strategy Consulting

Specific services, deliverables, timelines, and pricing will be outlined in individual project proposals or service agreements.

3. Payment Terms

Monthly Retainer Services:

• Payment is due monthly in advance on the 1st of each month
• Services commence upon receipt of first payment
• Late payments may result in service suspension after 7 days

Project-Based Services:

• 50% deposit required before work commences
• Remaining 50% due upon project completion
• Payment accepted via bank transfer, Revolut, or agreed payment methods

Refund Policy:

• 14-day money-back guarantee for all services (see our Refund Policy for details)
• Full refunds available if work hasn't started or is less than 10% complete
• Partial refunds prorated based on work completed
• Refund requests must be submitted to hello@creavibe.pro
• Refunds processed within 5-10 business days of approval

4. Client Responsibilities

You agree to:

• Provide timely access to necessary accounts, assets, and information
• Respond to requests for feedback within agreed timeframes
• Provide accurate information about your business and target audience
• Review and approve deliverables in a timely manner
• Make payments according to agreed terms

5. Intellectual Property

Client Content: You retain all rights to content, images, and materials you provide.

Deliverables: Upon full payment, you receive full rights to deliverables created specifically for your project (campaigns, content, strategies).

Tools & Templates: Proprietary tools, templates, and methodologies remain the property of Creavibe Digital and RoyalSoft LLC.

6. Confidentiality

Both parties agree to keep confidential all proprietary information shared during the engagement. This includes business strategies, customer data, financial information, and trade secrets.

7. Performance & Results

While we employ industry best practices and data-driven strategies, we cannot guarantee specific results (sales figures, follower counts, conversion rates, etc.) as marketing performance depends on numerous factors beyond our control including market conditions, competition, and client implementation of recommendations.

8. Termination

By Client: Monthly services may be terminated with 30 days written notice. Client remains responsible for payment through the notice period.

By Creavibe Digital: We reserve the right to terminate services immediately in case of non-payment, abusive behavior, or illegal activities.

Project-Based: Either party may terminate with written notice. Client responsible for payment for work completed to date.

9. Limitation of Liability

Creavibe Digital's liability is limited to the total amount paid for services in the 3 months preceding any claim. We are not liable for indirect, consequential, or incidental damages.

10. Compliance & Ethics

All services are provided in compliance with applicable laws and regulations. We adhere to platform guidelines (Facebook, Google, LinkedIn, etc.) and ethical marketing practices. Client agrees not to request services that violate laws or platform policies.

11. Payment Processing

Payments are securely processed by Revolut, a regulated financial institution authorized by the Financial Conduct Authority (FCA).

• Payment Security: All transactions are PCI-DSS compliant and encrypted
• Accepted Methods: Credit/debit cards, Revolut Pay, and bank transfers
• Payment Data: We do not store your card details - Revolut handles all payment information
• Dispute Rights: You have 120 days to dispute transactions with your card provider
• Chargeback Policy: Please contact us before initiating chargebacks to resolve issues faster

12. Data Protection

We comply with GDPR and applicable data protection regulations. See our Privacy Policy for details on how we handle data.

13. Service Delivery

Timeline Commitments:

• Project timelines will be agreed upon in writing before work commences
• We will notify you immediately if delays occur due to unforeseen circumstances
• Timelines may extend if client feedback or materials are delayed

Communication:

• We respond to all inquiries within 48 hours (usually same day during business hours)
• Regular progress updates provided for ongoing projects
• Priority support available for higher-tier service packages

14. Cancellation & Termination

Monthly Retainer Cancellation:

• 30 days written notice required via email to hello@creavibe.pro
• Services continue through end of paid period
• No cancellation fees or penalties
• Prorated refunds available for prepaid months not yet started

Project Cancellation:

• Before work starts: Full refund minus 10% administrative fee
• During project: Payment for work completed plus materials/expenses incurred
• After completion: No refunds once deliverables accepted

15. Prohibited Uses

You may not use our services for:

• Illegal activities or products
• Adult content, gambling, or weapons promotion
• Misleading or deceptive marketing practices
• Spam or unsolicited mass communications
• Violation of platform terms (Facebook, Google, LinkedIn, etc.)
• Infringement of intellectual property rights

16. Amendments

These terms may be updated periodically. Clients will be notified of material changes via email. Continued use of services constitutes acceptance of updated terms.

17. Governing Law

These terms are governed by the laws of the applicable jurisdiction. Any disputes will be resolved through good-faith negotiation first, then arbitration if necessary.
